Acceptable Use Policy
(“AUP”)

This AUP governs the use of CatsNine's web hosting service. Violation of this AUP may result in suspension or termination of your service. In the event of a dispute between you and CatsNine regarding the interpretation of this AUP, CatsNine's interpretation, in its reasonable commercial judgment, shall govern. Offensive Content

You may not publish or transmit via CatsNine's service any content that CatsNine reasonably believes:

Content “published or transmitted” via CatsNine's service includes Web content, e-mail, bulletin board postings, chat, and any other type of posting or transmission that relies on any Internet service provided by CatsNine.

Security

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically.

Bulk Commercial E-Mail

You must obtain CatsNine's advance approval for any bulk commercial e-mail, which will not be given unless you are able to demonstrate all of the following to CatsNine's reasonable satisfaction:

These policies apply to messages sent using your CatsNine service, or to messages sent from any network by you or any person on your behalf that directly or indirectly refer the recipient to a site hosted via your CatsNine service. In addition, you may not use a third party e-mail service that does not practice similar procedures for all its customers.

CatsNine may test and otherwise monitor your compliance with its requirements, including requesting opt-in information from a random sample of your list at any time.

Unsolicited E-Mail

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it.

You must comply with the rules of any other network you access or participate in using your CatsNine's services.

Material Protected by Copyright

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

Other

You must have valid and current information on file with your domain name registrar for any domain hosted on the CatsNine network.

Server resources
Any website on our shared servers that uses a high amount of server resources (CPU, memory usage, and network resources) will be given an option to pay for a dedicated server. The abuse and misuse of system resources is a serious problem, and CatsNine will not tolerate it. Accounts on a shared server must be shared with other users, so we must limit how much of the CPU and memory that can be used by any one account.

Memory usage may not exceed 15% per domain/file/application
CPU usage may not exceed 25% per domain/file/application
Apache connections may not exceed 30 connections
15 MySQL maximum user connections allowed
300 emails per hour, per domain

Chat Rooms

CatsNine does not provide nor allow chat rooms on shared hosting environments.

IRC

CatsNine does not allow IRC or IRC bots to be operated on our servers.

Credits

In the event that there is no web site availability, CatsNine will credit the monthly service charge for the service as calculated below and as measured 24 hours a day in a calendar month. The maximum credit is not to exceed the monthly service charge for the affected month:

95% to 99.9% = 25%
90% to 94.9% = 50%
89.9% or below = 100%

Restrictions

Credits shall not be provided to you in the event that you have no web site availability resulting from (i) scheduled maintenance, (ii) your behavior or the performance or failure of your equipment, programs or applications, or (iii) circumstances beyond CatsNine's reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of your Web Site.

Limitations

Online problems occur continuously. There might come a time when you cannot access your website or any other service. This is not necessarily due to CatsNine. Perhaps your ISP is experiencing technical difficulties, or there might be a routing problem between your ISP and the data center utilized and maintained by CatsNine, making communication difficult or impossible. We cannot bear the responsibility of such problems. Our monitoring agents determine the uptime of our service, and not any one client's experience.

Disclaimer

CatsNine is under no duty, and does not by this AUP undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any misuse of the CatsNine network. CatsNine reserves the right to add, delete, or modify any provision of this policy at any time without notice.
